Man gets Rs 10 lakhs for accident

A Motor Accident Claims Tribunal has awarded a compensation of over Rs 10 lakh to a 54-year-old man who suffered physical disability in an accident involving a rashly driven RTV in 2010. The tribunal directed National Insurance Company, with which the vehicle was insured, to pay Rs 10.24 lakh to Mandawali resident Kuwar Pal Singh. Singh was going home on his motorcycle when the RTV hit him near New Ashok Nagar on February 27, 2010.

"The petitioner (Singh) has proved the disability certificate as per which he suffered 66% permanent disability in relation to left upper limb. He is entitled to compensation on account of future loss due to disability," MACT presiding officer Ravinder Bedi said. Singh, who earned Rs 15,000 per month from running an advertisement company before the accident, had demanded a compensation of Rs 5 lakh.

The driver and the owner of the RTV had claimed that Singh was at fault as he was riding his motorcycle negligently in a zig-zag manner.

?The tribunal also noted that respondents (driver, owner and insurer of the bus) failed to lead any evidence despite being given opportunities.
